Cape Pool Cover (“we”, “us”, “our”), a division of Vida Tech, is committed to protecting your personal information. This Privacy Policy explains what information we collect when you use this website (capepoolcover.co.za) or contact us, how we use it, and the rights you have under the Protection of Personal Information Act, 4 of 2013 (“POPIA”).

By using this website or submitting a quote or contact request, you agree to the practices described below. If you do not agree, please do not use the site or submit information to us.

1. Who we are

Cape Pool Cover is a Cape Town-based pool builder and automated pool cover specialist trading as a division of Vida Tech. We are the responsible party (data controller) for the personal information described in this policy.

2. Information we collect

We only collect information that you choose to give us, or that is generated automatically when you visit the site.

Information you provide

• Contact form: your full name, email address, phone number, subject and the message you write to us.
• Quote request: contact details together with details about your pool or property (for example pool dimensions, location, cover type or build type you are interested in).
• Direct correspondence: anything you send us by email, phone, WhatsApp or social media.

Information collected automatically

• Standard server and analytics data such as your IP address, browser type, device type, referring page, pages visited and the date and time of your visit. This is collected by our hosting and analytics providers and is used in aggregate to keep the site secure and improve it.

We do not knowingly collect information from children under 18. If you are under 18, please ask a parent or guardian to contact us on your behalf.

3. Why we collect it and the legal basis

We process your personal information for the following purposes, on the legal bases set out in section 11 of POPIA:

• To respond to your enquiry or quote — based on the steps necessary to enter into a contract with you, and on your consent.
• To carry out work you have engaged us for — site visits, designs, quotations, installations, repairs and after-sales support, based on contract performance.
• To send you service-related communication — appointment reminders, follow-ups on quotes, invoices and warranty information, based on contract performance and our legitimate interests.
• To comply with the law — for example tax, accounting and consumer protection obligations.
• To improve the website and our services — based on our legitimate interests in running and improving our business.

We do not use your information for automated decision-making, profiling, or direct marketing without your separate consent.

4. Who we share it with

We do not sell your personal information. We share it only where necessary, with:

• Service providers (operators) who help us run the business — for example our website hosting provider (Vercel Inc.), email host, accounting software, and payment processors. These parties are bound to use the information only to provide the relevant service to us.
• Sub-contractors we engage to complete a project for you (for example tilers, electricians or pool builders), where their work requires it.
• Authorities where we are required to disclose information by law, court order, or to protect our legal rights.

Some of our service providers (for example our hosting provider) store data outside of South Africa. Where this happens, we rely on the cross-border transfer conditions in section 72 of POPIA, including that the recipient is subject to a law or binding agreement that provides an adequate level of protection.

5. Cookies and similar technologies

This website uses a minimal number of cookies and similar technologies. These include strictly necessary cookies that make the site work, and may include analytics cookies that help us understand how the site is used. You can control or block cookies through your browser settings. Blocking some cookies may affect the functionality of the site.

6. How long we keep it

We keep personal information only as long as we need it for the purpose for which it was collected, including for legal, tax and accounting purposes. In practice this means:

• Enquiries that do not lead to work: typically up to 24 months.
• Customer records (quotes, invoices, project records): at least 5 years after the last interaction, to comply with the Tax Administration Act and other applicable laws.
• Warranty-related records: for the duration of the applicable warranty, plus 3 years.

7. How we protect it

We take reasonable technical and organisational measures to safeguard your personal information against loss, damage and unauthorised access, including secure hosting, access controls on our devices and accounts, and encrypted transport (HTTPS) for data sent to and from this website. No system is perfectly secure, so we cannot guarantee absolute security, but we do our best to keep your information safe.

If a security compromise affects your personal information, we will notify you and the Information Regulator as required by section 22 of POPIA.

8. Your rights under POPIA

Subject to the conditions in POPIA, you have the right to:

• Be told what personal information we hold about you;
• Request a copy of, or correction or deletion of, your personal information;
• Object to processing of your personal information;
• Withdraw any consent you have given us, at any time;
• Complain to the Information Regulator if you believe we have not handled your personal information lawfully. The Regulator can be contacted at inforegulator.org.za.

9. Third-party links

Our website may link to third-party websites (for example our social media profiles). We are not responsible for the privacy practices of those sites. Please read their privacy policies before sharing any personal information.
